1 The Competition
1.1 Information on how to enter the competition, “Win a $5,000 Music Performance for your Business Christmas Party” (Competition), any forms, the First Prize and Runner-Up Prizes (together, the Prizes) and rules for redeeming the Prizes form part of these terms and conditions.
1.2 By submitting an entry in the Competition, that person agrees to be bound by these terms and conditions (Competition Terms and Conditions).
2 Organiser
This Competition is organised and held by Australasian Performing Right Association Ltd (ABN 42 000 016 099) of 16 Mountain Street, Ultimo, New South Wales, 2007, trading as OneMusic Australia (Organiser).
3 Entrant Eligibility
3.1 Entry is open to any person that is the owner, operator or proprietor of a business operating in Australia or their authorised representative, whether or not that business currently holds a OneMusic licence.
3.2 Entrant means any person, meeting the eligibility criteria at clause 3.1, that lodges an entry in accordance with clause 4.
3.3 Employees of the Organiser (and their immediate families) are ineligible to enter.
4 Entries
4.1 To enter validly, Entrants must properly complete and submit the Competition entry form online at https://lp.onemusic.com.au/christmas-party-competition#enter-to-win
4.2 Each entry must include a response to the request, “In 25 words or less, tell us what makes Australian music great?”, which will be individually judged in accordance with clause 6. The Competition is a game of skill only. Chance plays no part in determining the Winner and Runners-Up.
4.3 Upon submitting an Entry into the Competition, if the Entrant does not hold a current OneMusic licence, the Entrant agrees to be contacted by the Organiser to discuss the Entrant’s music licensing arrangements for their business, in accordance with OneMusic’s privacy statement set out in clause 12.
4.4 Each entry must include information in adequate detail to allow the Organiser to identify the Entrant for the purposes of determining the Winner and Runners-Up, including name and address details, and email and phone contact details.
4.5 The Organiser may verify the validity of entries and may disqualify any Entrant for any reason at the Organiser's sole discretion. An entry which does not comply with the Competition Terms and Conditions is invalid.
4.6 It is the Entrant's responsibility to ensure that his, her or their entry submitted is complete. Incomplete, indecipherable or illegible entries will be deemed invalid.
4.7 Entering the Competition does not guarantee that an Entrant will win a Prize or derive any other benefit.
4.8 The Entrant, herein, grants the Organiser all rights necessary for the Organiser to use his, her or their entry for the purposes of the Competition.
4.9 Entries are final once received by the Organiser and cannot be amended once submitted.
5 Competition Period
5.1 The Competition commences on 20 March 2025 at 9am AEST and concludes on 18 September 2025 at 11:59pm AEST (Competition Period). The Organiser will not be liable for any change to the Competition Period.
5.2 All entries must be received by the Organiser prior to the end of the Competition Period. Entries are deemed to be received at the time of receipt by the Organiser not the time of submission by the Entrant. The Organiser is not responsible for failure to receive any entry, whether for any cause beyond its control or otherwise.
6 Judging
6.1 The Organiser will appoint, from its personnel, a three-person judging committee (Judges).
6.2 Each valid entry will be evaluated by the Judges and judged on its merits to be the most original and creative entry to determine a single winning Entrant (Winner) and up to ten (10) runner-up Entrants (Runners-Up).
6.3 Judgement of entries is at the absolute discretion of the Organiser and Judges. The decisions of the Organiser and Judges with respect to the Competition are final and no correspondence will be entered into. For the avoidance of doubt, the Organiser and Judges will not provide Entrants with feedback or a critique with respect to entries.
7 Winner and Runners-Up
7.1 The Organiser will use its best endeavours to announce the Winner and Runners-Up by 26 September 2025 but will not be held liable for any unforeseen delays in the judging process.
7.2 The Winner and Runners-Up will be notified by email or telephone.
8 First Prize
8.1 The prize awarded to the Winner is subject to the First Prize Conditions at clause 9 and comprises a live music performance at the Winner’s corporate event (Event), consisting of the following (First Prize):
(a) an appearance and performance by a performer or performers to be mutually agreed between the Organiser and the Winner having regard to the nature and needs of the Event;
(b) if required, audiovisual equipment hired to facilitate the performance at the Event;
(c) travel, accommodation and associated costs for the performer(s) and crew required to stage the Event; and
8.2 The total First Prize is estimated to be valued up to a maximum of AU$5,000 (GST-inclusive).
8.3 The First Prize values are correct at the time of publication, but no responsibility is accepted by the Organiser for any variation in the value of the First Prize or part of the First Prize. If, for any reason, the First Prize, or part of the First Prize, is not available or otherwise cannot be granted by the Organiser and has a value, the Organiser reserves the right to substitute the First Prize, or part of the First Prize, for a prize of similar value.
9 First Prize Conditions
9.1 First Prize Conditions means this clause 9 and its subclauses in their entirety, which forms the terms and conditions of the First Prize awarded to the Winner.
9.2 The date and time of the Event will be determined by the Winner and the Organiser but must occur between 15 October 2025 and 19 December 2025.
9.3 The Winner is responsible for selecting and hiring a suitable venue to host the Event. The Winner agrees that it will pay any relevant venue hire fees and associated fees if the Event is hosted offsite from the Winner’s business premises.
9.4 On no less than 30 days’ written notice to the Organiser, the Winner may change the date of the Event one (1) time to another date within the timeframe specified at clause 9.2. Any further changes to the date of the Event will constitute forfeiture of any Prize.
9.5 The Event must be for the purposes of the Winner’s business and must not take place at any event held in a personal capacity or otherwise outside of association with the Winner’s business.
9.6 The Winner agrees to display OneMusic branded signage near the performer at the Event. The Organiser will arrange and pay for transport of signage to and from the venue.
9.7 The Winner agrees to participate in publicity for the event for the promotional purposes of the Organiser.
9.8 In the event that the Winner does not hold a OneMusic licence suitable to cover the public performance of OneMusic’s music at the Event, the Organiser will obtain, on the Winner’s behalf, the appropriate licence(s) to cover the public performance of OneMusic’s music at the Event.
9.9 The First Prize will be awarded in full to the Winner and is not transferable or exchangeable. The Organiser is not liable in any way if the Winner cannot receive, accept or use any element of the First Prize for any reason. The First Prize (or any part thereof) may be cancelled at the Organiser's discretion if the Winner attempts to transfer it.
9.10 The Organiser will not cover any associated costs in connection with the Winner’s enjoyment of the First Prize other than those expressly stipulated in these Competition Terms and Conditions. Without limiting anything else in the Competition Terms and Conditions, the Winner is not entitled to any reimbursement of any kind as a result of entering the Competition or enjoying or participating in the First Prize or part of the First Prize. Any taxes payable in relation to the First Prize are the sole responsibility of the Winner.
9.11 The Organiser has the right to refuse to allow any Winner to take part in all or part of the First Prize, if the Organiser deems, at its discretion, that a Winner is not in an appropriate physical or mental condition to ensure the safety of any parties involved in the First Prize, or the Organiser otherwise deems that it is not appropriate for the Winner to take part in all or part of the First Prize for any reason.
10 Runner-Up Prizes
10.1 The prizes awarded to the Runners-Up are subject to the Runner-Up Prize Conditions at clause 11 and comprise up to ten (10) gift cards redeemable at JB Hi-Fi (each a Runner-Up Prize).
10.2 Each Runner-Up Prize will be to the value of AU$300 (GST-inclusive).
10.3 The Runner-Up Prize values are correct at the time of publication, but no responsibility is accepted by the Organiser for any variation in the value of any Runner-Up Prize or part of any Runner-Up Prize. If, for any reason, any Runner-Up Prize, or part of any Runner-Up Prize, is not available or otherwise cannot be granted by the Organiser and has a value, the Organiser reserves the right to substitute any Runner-Up Prize, or part of any Runner-Up Prize, for a prize of similar value.
11 Runner-Up Prize Conditions
11.1 Runner-Up Prize Conditions means this clause 11 and its subclauses in their entirety, which forms the terms and conditions of any Runner-Up Prize rewarded to any Runner-Up.

12 Privacy
All details of the Entrant with be handled in accordance with the Organiser's privacy statement which can be viewed at https://onemusic.com.au/support/privacy-statement/.
13 Licences, Warranties and Indemnities
13.1 By entering the Competition, The Entrant agrees:
(a) that the Organiser may, in its sole discretion, disqualify an Entrant for an Entry that the Organiser deems to be offensive, inappropriate, defamatory, infringes the rights of any third party including copyright or is otherwise against the law; and
(b) that should he, she or they be selected as the Winner or a Runner-Up, the Organiser shall have permission to use that Entry, as well as the Entrant's name, business name, likeness, and voice solely for any and all advertising and publicity purposes in connection with the Competition, including on websites or social media channels controlled by the Organiser, without additional compensation.
13.2 The Organiser will not be liable for:
(a) any loss, damage, payment or expense of any kind (including but not limited to indirect or consequential loss or damage caused by the Organiser's or other party's negligence), or personal injury or other damage suffered or sustained as a result of entering, judging, running, cancellation or acceptance, enjoyment or use of the Competition or the Prizes (or part thereof), except for any liability that cannot be excluded by law. The Entrant indemnifies the Organiser against all liabilities, losses, damages, costs and expenses (including all legal costs, whether incurred or awarded) suffered or incurred by the Organiser in relation to any breach by the Entrant of its obligations under the Competition Terms and Conditions;
(b) the loss or destruction of any materials comprised in the Entry. Entrants should retain a copy of all materials submitted; or
(c) any loss or damage of any kind (including but not limited to indirect or consequential loss or loss or damage caused by the Organiser's or other party's negligence) arising out of, or in connection with, the postponement or variation of the Competition or the Prizes (or part thereof).
13.3 Entrants agree to release, indemnify, and hold the Organiser and Judges harmless for any liability, damages, or claims for injury or loss to any person or property relating to, in whole or in part, directly or indirectly, participation in the Competition.
13.4 Entrants agree to hold an appropriate level of public liability insurance coverage in respect of the First Prize and the Event.
13.5 The Organiser agrees to ensure that the performer(s) and any entity engaged by the Organiser in its provision of the Prizes will hold an appropriate level of public liability insurance coverage in respect of the Prizes.
14 Miscellaneous
14.1 If the Competition is not able to be run as planned due to any event beyond the Organiser’s reasonable control, the Organiser may cancel, terminate, modify or suspend the Competition.
14.2 Failure by the Organiser to enforce any of its rights at any stage does not constitute a waiver of those rights.
14.3 The Organiser reserves the right, in its absolute discretion, at any time during the Competition Period, to vary, withdraw, postpone or cancel the Competition or Prizes including without limitation, in circumstances where it cannot conduct the Competition or grant any part of the Prizes for any reason beyond its control. In the event the Competition is cancelled in its entirety, Entrants will be notified by email.
15 Variation
15.1 Entrants acknowledge and agree that the Organiser may amend the Competition Terms and Conditions at any time provided that the Organiser provides reasonable notice to Entrants of any such amendments.
15.2 Entrants that do not agree with the amended Competition Terms and Conditions as notified may withdraw from the Competition by providing written notice by email to the Organiser at: hello@onemusic.com.au
16 Governing Law
The Competition including the Competition Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia and all Entrants irrevocably and unconditionally agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia.
